Litigation, Estates, Real Estate and Business Lawyer

Kieran Simpson is a lawyer in the Invermere office of Columbia Valley Law Corporation. He maintains a broad practice that includes civil litigation, estate planning and administration, real estate, and corporate and commercial law.

Kieran assists individuals, families, businesses and organizations with disputes, transactions and planning. His approach is thoughtful, practical and grounded in careful legal research. He works with clients to understand the problem, identify the available options and develop a strategy proportionate to what is at stake.

Civil Litigation

Kieran represents clients in civil disputes, including commercial, contractual, property and estate-related matters.

His litigation work includes:

  • Assessing potential claims and defences
  • Legal research and analysis
  • Preparing pleadings and court materials
  • Document disclosure and production
  • Chambers applications
  • Negotiation and settlement
  • Preparing for examinations for discovery, mediation and trial
  • Appeals and enforcement proceedings

Litigation requires close attention to detail without losing sight of the client’s larger objective. Kieran helps clients assess the strength of their position, the evidence required, the cost and risk of different procedural steps, and the available opportunities for resolution.

Kieran’s objective is to provide clients with clear advice, careful preparation and a realistic understanding of the available path forward.

Wills and Estates

Kieran assists clients with estate planning, including wills, enduring powers of attorney and representation agreements. He also advises executors and administrators on probate and estate administration.

Estate planning often brings legal, financial and family considerations together. Kieran helps clients understand how matters such as jointly owned property, beneficiary designations, family obligations and incapacity planning may affect whether a plan will work as intended.

When assisting with estate administration, Kieran helps personal representatives understand their responsibilities, prepare applications for estate grants and address the collection, transfer and distribution of estate assets.

Kieran also works on estate disputes involving matters such as:

  • The validity or interpretation of a will
  • Capacity and undue influence
  • The conduct of an executor or trustee
  • Ownership of estate assets
  • Jointly held property
  • Beneficiary designations
  • Wills-variation claims
  • Estate accounts and distributions

His combined planning and litigation experience helps him recognize how drafting, administration and disputed claims can affect one another.

Real Estate

Kieran advises clients on residential and other real estate matters. He helps buyers, sellers and property owners understand the transaction, satisfy legal and lender requirements, and address issues affecting title or ownership.

His work may include:

  • Residential purchases and sales
  • Mortgage and refinancing transactions
  • Transfers between family members
  • Joint ownership arrangements
  • Easements, covenants and title matters
  • Estate-related transfers of real property
  • Property disputes

Real estate work often requires coordination among clients, lenders, real estate professionals and opposing lawyers. Kieran works to keep that process organized while ensuring that clients understand the documents they are signing and the obligations they are assuming.

Corporate and Commercial Law

Kieran assists businesses and non-profit organizations with incorporations, corporate records, contracts and other organizational matters.

His work may include:

  • Incorporating companies and societies
  • Preparing organizational documents
  • Corporate annual maintenance
  • Share issuances and transfers
  • Commercial agreements
  • Governance matters
  • Business purchases and sales
  • Corporate reorganizations

For small businesses, corporate questions are rarely isolated from the owners’ broader financial and personal circumstances. Kieran provides practical advice intended to help clients understand both the immediate transaction and its longer-term consequences.

Environmental and Indigenous-Law Background

Kieran grew up in the Kootenays and returned to the region to begin his legal career after completing his law degree at Dalhousie University’s Schulich School of Law in 2023. During law school, he concentrated on environmental law and Aboriginal and Indigenous law.

He served as an executive member of the Environmental Law Students’ Society and as a student representative on the board of East Coast Environmental Law. He also completed pro bono work and a work placement with East Coast Environmental Law and conducted research with Dalhousie’s Marine & Environmental Law Institute concerning coastal adaptation to climate change.

Before and during law school, Kieran worked with environmental organizations including Wildsight, Watershed Watch Salmon Society and East Coast Environmental Law. He has also served as a Regional Board Director with Wildsight.

Kieran is the co-author, with Ben R. Collison, of “International Law Application to Transboundary Pollution: Solutions to Mitigate Mining Contamination in the Elk–Kootenai River Watershed.” The work examines international legal mechanisms for addressing mining pollution in the transboundary watershed and was republished as a chapter in Advances in Environmental Law in 2024.

A Kootenay Practice

Kieran’s broad practice reflects the interconnected legal needs of individuals, businesses and organizations in smaller British Columbia communities. A property matter may raise corporate questions; an estate may involve land or a family dispute; and a commercial disagreement may require both negotiation and litigation planning.

Kieran helps clients identify those connections and address the whole problem rather than treating each legal issue in isolation.
